What challenges will I face in my Workers Compensation claim?

Workers Compensation is a series of state laws for the care of employees who are injured during the execution of work-related tasks. Most states require almost all employers to carry workers compensation insurance. In Georgia, for example, every company with more than three employees offer this coverage.

Benefits vary by state law, but in general, you may be entitled to:

Total disability, either temporary or permanent
Partial disability
Payment of medicalInvoices
If you work in a position, but not to the same work, your employer is usually required to get you another job you can do if one exists at the firm.

If you are injured

Talk to a lawyer when you are injured. Although you can represent yourself, a lawyer can ensure that your claim file correctly and get all the benefits you are entitled. In Georgia and in most states, you are usually with a claim by the State Workers Compensation Board and provide fileCopies to your employer and its insurance carrier.

Your lawyer can also ensure that all the documents you need to make your case to prove as follows:

Medical reports, including diagnosis, treatment and how the work-related injury
Rehab Reports
Everyone expected disability
Prescription revenue
Unpaid medical bills
Common Hurdles

Some stumbling blocks you may encounter in your claim, include:

Your Employer: Your employer may contest your right to benefits bysaid the injury was not work related or that you exaggerate your injuries. Some employers, you can even cause a fire and then try to ignore your claim.
The application process: Incomplete forms can until your hearing, and any missing information may reduce your award amount.
Denied Claims: legitimate claims should not be denied, but if yours is, you have the right to appeal. You must do so within the time frame set by state law. In Georgia, for example, you have 20 days from the date ofthe refusal of a file.
